Please read these Terms of Service ("Terms") carefully before using the website located at PastelProtein.com (the "Site") or purchasing any products offered by Pastel Protein LLC ("Pastel Protein," "we," "us," or "our"). By accessing or using the Site, placing an order, creating an account, or otherwise engaging with our products or services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Site or purchase our products.
1. About Us
Pastel Protein LLC is a Wyoming limited liability company. Our products are manufactured by third-party co-manufacturers and shipped and fulfilled through our third-party logistics partner. For customer support, contact us at Support@PastelProtein.com. We aim to respond to all inquiries within two business days.
2. Eligibility
By using this Site and placing an order, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement under applicable law, and are located within the United States at the time of purchase. Our products and Site are intended for use by individuals 18 years of age or older. We do not knowingly collect personal information from or sell products directly to persons under the age of 13. If you are between the ages of 13 and 18, you may only use the Site with the involvement and consent of a parent or legal guardian.
3. Products
All product descriptions, images, ingredient lists, and specifications on the Site are provided in good faith and to the best of our knowledge at the time of publication. We reserve the right to modify product formulations, ingredients, packaging, pricing, or availability at any time without prior notice. Product images are for illustrative purposes only and the actual product received may vary slightly in appearance.
Pastel Protein products are food products. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition and are not a substitute for professional medical advice. If you have food allergies, dietary restrictions, or underlying health conditions, you must consult a qualified healthcare professional before consuming our products. It is your sole responsibility to review the complete ingredient list and allergen information on the product label prior to consumption. Pastel Protein is not liable for adverse reactions resulting from failure to read and follow product labeling.
4. Orders and Payment
By placing an order on the Site, you represent that all information you provide is accurate, current, and complete. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including but not limited to cases involving suspected fraud, payment issues, pricing errors, or product availability constraints. If your order is cancelled after payment is collected, you will be notified and a full refund will be issued to your original payment method.
All prices are displayed in United States dollars. Prices are subject to change at any time without prior notice. Applicable state and local sales tax will be calculated at checkout based on your delivery address. You are solely responsible for any applicable taxes, duties, or fees beyond those collected by us at checkout.
Payment is processed securely through Shopify Payments using industry-standard encryption. We accept all major credit and debit cards. By submitting your payment information, you authorize us to charge the full purchase amount, including any applicable taxes and shipping fees, to your selected payment method. All financial transactions are subject to the terms and conditions of Shopify Payments.
5. Shipping
We currently ship to addresses within the fifty United States and US territories. We do not ship to P.O. Boxes, APO/FPO/DPO addresses, or international destinations. Estimated delivery times displayed at checkout are estimates only and are not guaranteed. Pastel Protein is not responsible for shipping delays caused by carriers, weather events, natural disasters, labor disputes, or other circumstances outside our reasonable control.
Title and risk of loss for all products pass to you upon our delivery of the product to the shipping carrier. If your shipment is lost in transit prior to confirmed delivery, please contact us at Support@PastelProtein.com and we will open a carrier investigation on your behalf. Pastel Protein is not liable for packages that have been confirmed as delivered by the carrier to the address provided at checkout.
6. All Sales Final -- Damaged or Defective Product
Because our products are consumable food items, ALL SALES ARE FINAL. We do not accept returns or exchanges for any reason and do not issue refunds except as expressly provided in this section.
DAMAGED OR DEFECTIVE PRODUCT: If your product arrives physically damaged, defective, or materially different from what was described on the Site at the time of purchase, you must notify us at Support@PastelProtein.com within 14 days of the confirmed delivery date. Your notification must include your order number and clear photographic evidence of the damage or defect. We will evaluate each claim individually and, at our sole discretion, provide either a full refund to your original payment method or a replacement product at no additional charge. Where a physical return is required, Pastel Protein will provide a prepaid return shipping label.
We reserve the right to request additional documentation to verify any claim. Claims submitted more than 14 days after confirmed delivery, or submitted without the required order number and photographic documentation, are not eligible for a refund or replacement. Pastel Protein is not responsible for damage resulting from misuse, improper storage after delivery, failure to follow preparation or storage instructions, or any circumstances beyond our control following delivery to the carrier.
PRIOR CONTACT REQUIRED: We are committed to resolving all customer concerns promptly and in good faith. Before initiating any payment dispute with your bank or card issuer, you agree to contact us at Support@PastelProtein.com and allow us at least 10 business days to resolve your concern. We will make every reasonable effort to resolve your issue directly. This requirement does not limit any rights you have under applicable federal or state consumer protection laws.
7. Marketing Communications and Customer Data
By placing an order or creating an account on the Site, you acknowledge that Pastel Protein may use your name, email address, purchase history, and other information you provide to send you marketing and promotional communications, including but not limited to: product announcements, special offers, promotional discounts, newsletters, and brand updates. This use of your information is further described in our Privacy Policy.
You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by contacting us at Support@PastelProtein.com. Opting out of marketing communications will not affect your ability to receive transactional emails related to your orders. We will process opt-out requests within 10 business days.
8. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, product names, brand names, audio and video clips, digital downloads, and the overall look, feel, and design of the Site, is the exclusive property of Pastel Protein LLC or its licensors and is protected under applicable United States and international copyright, trademark, trade dress, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. No other use is permitted without our prior written consent.
PASTEL, PASTEL PROTEIN, and associated logos, slogans, and brand elements are trademarks or pending trademarks of Pastel Protein LLC in the United States. Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or brand identifiers without our express prior written permission. Unauthorized use of our intellectual property is strictly prohibited and may result in legal action.
9. User Conduct
By accessing the Site, you agree not to: (a) use the Site for any purpose that violates any applicable federal, state, local, or international law or regulation; (b) attempt to gain unauthorized access to any portion of the Site, its servers, or any other systems connected to the Site; (c) transmit any unsolicited, harmful, defamatory, obscene, harassing, or otherwise objectionable content; (d) impersonate any person or entity or falsely represent your affiliation with any person or entity; (e) use any automated means including bots, scrapers, or crawlers to collect data from the Site without our express written permission; (f) interfere with or disrupt the integrity or performance of the Site or any data contained therein; or (g) engage in any conduct that restricts or inhibits any other person from using or enjoying the Site.
10. Third-Party Links and Services
The Site may contain links to third-party websites, platforms, or services that are not owned or controlled by Pastel Protein, including but not limited to social media platforms, advertising networks, and payment processors. We provide these links for convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party websites or services. Your use of third-party sites is governed solely by the terms applicable to those sites. We encourage you to review the terms and privacy policies of every third-party site you visit.
11. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PASTEL PROTEIN EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. PASTEL PROTEIN DOES NOT WARRANT THAT THE SITE WILL OPERATE WITHOUT INTERRUPTION OR ERROR, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE AND PURCHASE OF OUR PRODUCTS IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PASTEL PROTEIN LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, YOUR PURCHASE OF PRODUCTS, OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PASTEL PROTEIN'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO PASTEL PROTEIN IN THE SIX-MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.
SOME STATES AND JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN TYPES OF LIABILITY OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
13. Indemnification
You agree to defend, indemnify, and hold harmless Pastel Protein LLC and its members, managers, officers, employees, agents, suppliers, and affiliates from and against any and all third-party claims, actions, suits, proceedings, losses, liabilities, damages, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your access to or use of the Site; (b) your purchase or use of our products; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of a third party. We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without giving effect to any principles of conflicts of law. You agree that any cause of action arising out of or related to these Terms or the Site that is not subject to arbitration as provided in Section 15 must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action is permanently barred.
15. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND CONTAINS AN AGREEMENT TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION RATHER THAN IN COURT.
INFORMAL RESOLUTION: Before initiating any formal dispute proceeding, you agree to contact us at Support@PastelProtein.com and provide a written description of your dispute, the relief you are seeking, and your contact information. We will attempt to resolve the dispute informally within 30 days of receiving your notice. If we are unable to resolve the dispute informally within 30 days, either party may initiate arbitration as provided below.
BINDING ARBITRATION: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Site, or our products -- including questions about the existence, validity, or termination of these Terms -- shall be finally resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, except as modified herein. The arbitration shall be conducted in the English language. The arbitrator shall have exclusive authority to resolve all disputes, including disputes regarding the interpretation, applicability, enforceability, or formation of these Terms. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
EXCEPTIONS TO ARBITRATION: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent or enjoin infringement of intellectual property rights or misappropriation of trade secrets, or where immediate irreparable harm would otherwise result. Nothing in this section prevents either party from bringing an individual action in small claims court where jurisdiction and venue are proper.
CLASS ACTION WAIVER: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE, THEN THE AGREEMENT TO ARBITRATE SHALL BE NULL AND VOID.
OPT-OUT RIGHT: You may opt out of this arbitration agreement by sending written notice to Support@PastelProtein.com within 30 days of first using the Site or purchasing our products. Your opt-out notice must include your name, address, and a clear statement that you are opting out of the arbitration agreement. Opting out does not affect any other provision of these Terms.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect. The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision in any other jurisdiction.
17. Waiver
No waiver by Pastel Protein of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Pastel Protein to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Site, constitute the entire and exclusive agreement between you and Pastel Protein LLC regarding your use of the Site and purchase of our products, and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, between you and Pastel Protein relating to the Site or our products.
19. Changes to These Terms
We reserve the right to update, modify, or replace any part of these Terms at any time in our sole discretion. We will provide notice of material changes by updating the "Last Updated" date at the top of this page. For significant changes, we may also provide additional notice such as an email notification or a prominent notice on the Site. Your continued use of the Site or purchase of products after the effective date of any modification constitutes your binding acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site immediately.
